Terms and Conditions

Article 1. Definitions

In these terms and conditions:

  • ParaDemo: the natural person or legal entity using these terms and conditions;
  • Client: the counterparty of ParaDemo;
  • Agreement: the agreement between ParaDemo and Client;
  • Service: the service to be provided by ParaDemo, including skydiving, tandem jumps, demonstrations and related activities.

Article 2. Applicability

2.1. These terms and conditions apply to all offers, quotations and agreements by ParaDemo.

2.2. Deviations from these terms are only valid if expressly agreed in writing.

2.3. Any purchase or other terms of Client do not apply.

Article 3. Price and Payment

3.1. All prices used by ParaDemo applicable to the delivery of offered goods and/or services are made known by ParaDemo prior to concluding the agreement.

3.2. Prices always include VAT and other government-imposed levies.

3.3. ParaDemo expressly reserves the right to increase prices, even after concluding an agreement, as a result of increases in fuel and/or landing prices.

3.4. Payment of the price must take place before delivery.

3.5. In case of late payment, ParaDemo expressly reserves the right to suspend the agreed performance until the payment obligation is fulfilled, or to terminate the agreement wholly or partially without legal intervention. The Client remains liable for the agreed price.

3.6. If the Client fails to pay the agreed price on time, ParaDemo reserves the right to charge statutory interest and extrajudicial collection costs, in accordance with applicable legal provisions.

3.7. Amounts paid by the Client are not refunded. ParaDemo points out to the Client the possibility of taking out travel or cancellation insurance.

Article 4. Liability

4.1. By entering into an agreement with ParaDemo, the Client expressly acknowledges being aware that skydiving and all related activities may involve health risks and may result in property damage, personal injury and death.

4.2. The Client expressly indemnifies ParaDemo for damage suffered by him/her or any third party as a result of skydiving, related activities and the purchase or rental of materials from ParaDemo.

4.3. If ParaDemo is nevertheless deemed liable under law for any damage to the Client or third parties, ParaDemo can only be held liable to compensate direct damage. Compensation for any consequential damage is expressly excluded.

4.4. ParaDemo is affiliated with the KNVvL, skydiving division. The KNVvL has taken out a statutory liability policy, which ParaDemo can invoke if applicable. ParaDemo's liability is always limited to the amount paid out by the statutory liability insurer. Upon request, ParaDemo provides a copy of the aforementioned policy. The Client is free to independently insure themselves at any time.

Article 5. Service Performance

5.1. ParaDemo performs the service to the best of its ability in accordance with the agreements made.

5.2. All times provided by ParaDemo are indicative and may be influenced by weather conditions and other external factors.

5.3. ParaDemo has the right to postpone or cancel service performance for safety reasons, weather conditions or other circumstances beyond its control.

Article 6. Tandem Jumps

6.1. ParaDemo reserves the right to refuse to enter into an agreement without stating reasons. Tandem jumps cannot be made by persons whose body weight exceeds 100 kilograms.

6.2. When a tandem jump is cancelled due to force majeure on ParaDemo's part, which must also expressly include: strikes, orders from the aircraft lessor based on safety considerations, technical failures, and other reasons concerning the Client's safety (including weather conditions), ParaDemo can never be held liable and no compensation of any kind will be paid to the Client.

6.3. ParaDemo will give the Client as much opportunity as possible to make up for the tandem jump missed for reasons mentioned under 6.2., within 12 months after the date set for this purpose.

6.4. Concluded agreements regarding tandem jumps are bound to the person of the Client and therefore non-transferable.

6.5. The Client will at all times comply with applicable legal provisions and follow all instructions or directions given to him/her by or on behalf of ParaDemo's management or employees.

6.6. ParaDemo reserves the right to exclude the Client from participation in a tandem jump for compelling reasons. Compelling reasons include at least failure to comply with what is included under article 6.5., and the Client's unsuitability for practicing the parachute sport, so that an unacceptable danger to the Client or others may arise, this at ParaDemo's discretion.

6.7. If a tandem jump is not performed due to the compelling reasons mentioned in article 6.6., the Client cannot claim restitution of course fees already paid or any form of compensation.

Article 7. Publicity Material/Intellectual Property Rights

7.1. Intellectual property rights to photos, DVDs or other image carriers made by or on behalf of ParaDemo always remain with ParaDemo. ParaDemo has the right to use these, including for publicity purposes, even if the Client's image or portrait is included. Insofar as necessary, the Client transfers image or portrait rights to ParaDemo.

Article 8. Force Majeure

8.1. ParaDemo is not obliged to fulfill any obligation if it is unable to do so as a result of force majeure.

8.2. Force majeure means any circumstance independent of ParaDemo's will that prevents performance permanently or temporarily.

Article 9. Complaints

9.1. Complaints about service provision must be submitted in writing within 7 days after service provision.

9.2. ParaDemo will handle complaints within 14 days after receipt.

Article 10. Final Provisions

10.1. Dutch law applies to all agreements and offers by ParaDemo and to these terms and conditions.

10.2. All disputes of any nature related to/arising from agreements entered into by us and deliveries made by us are judged by the competent court of the District Court of Zutphen.

10.3. If a provision of these terms and conditions proves to be null or voidable, the other provisions remain in full force.
